Legal obligations

The legislation mandates the investigation of abuses and complaints as follows:


For organizations employing more than 250 employees and falling under the scope of the Labor Code, as of July 24, 2023.

For companies employing 50-250 employees, in effect from December 17, 2023.

Interpretation of the Regulation

The essence of the new regulation is that

it enables the reporting of any unlawful actions, even in privately-owned companies.

These may include, but are not limited to, abuses against employees (such as providing poor working conditions, unpaid overtime, undocumented employment, harassment, etc.) as a primary concern, and other misconducts (such as corruption, budget fraud, embezzlement, theft, extortion, etc.) as secondary concerns.

If an employee makes a report, their job position is protected by law.

However, false reporting is punishable by law.

Whistleblower Protection

A whistleblower protection lawyer

can only be a person (law firm) who has not been in a legal relationship with the respective company for at least five years.

The lawyer must operate a separate phone number and email address to receive the reports.

Documents related to the reports must be kept separate from other documents.

The identity of the whistleblower may remain anonymous during the procedure.

The whistleblower protection lawyer is obliged to report to the territorial bar association with which company they are in a legal relationship.

At our firm, only an administrator is informed about the fact of receiving the complaint (report) and its registration, while only the lead attorney of our office is informed about its content. This procedure practically eliminates the possibility of data leakage, which can be crucial for a company in a sensitive legal situation.
